General Terms and Conditions of Sale

The website www.grungemama.fr (hereinafter the "Site") is published by the company Grungemama , SASU with a capital of €3,000, registered with the RCS of Toulouse under number 819 704 990 , intra-community VAT FR 82819704990 , registered office: 14 bis avenue Hermès, 31240 L'Union .

Purchases on the Site are reserved for consumers. These general terms and conditions of sale (hereinafter "GTC") govern the relationship between Grungemama (the "Seller") and any non-commercial individual (the "Buyer") wishing to purchase the products offered (the "Products").

1. Purpose and acceptance

The Terms and Conditions define the rights and obligations of the parties for any online sale made via the Website. By validating the order, the Buyer acknowledges having read and accepted the Terms and Conditions without reservation.

The applicable terms and conditions are those in effect online on the date of the order. The Seller may modify them at any time; the version published on the Website shall prevail.

2. Orders

Orders are placed online, subject to stock availability. If an item becomes unavailable after ordering, the Buyer will be notified by email and refunded the price of the unavailable product using the original payment method.

The Buyer can place an order by creating an account or as a guest (by entering an email address). The information provided must be accurate and kept up to date. In the event of an incorrect address, the Seller is not responsible for the inability to deliver.

Before payment, a summary (products, quantities, prices, fees) is displayed in the shopping cart. The buyer can modify it until validation.

3. Validation, electronic signature and proof

Final validation constitutes an electronic signature and a commitment to pay. It formalizes acceptance of the General Terms and Conditions, the Products, their price, and associated fees.

A summary confirmation email is sent. The Seller's computerized records (orders, invoices, payments), stored under reasonable security conditions, serve as proof of the transactions.

4. Prices, currencies and taxes

  • Display : prices are shown in euros (€) inclusive of all applicable French taxes, excluding delivery charges, which are specified before validation.
  • Changes : The Seller may change its prices at any time; the applicable price is the one displayed at the time of the order.
  • International / Customs : For deliveries outside the European Union (or specific customs zones), import duties and taxes may apply and remain the responsibility of the Buyer upon arrival of the package.

    For deliveries outside the European Union, any customs duties remain the responsibility of the customer. If these fees are not paid or the package is not collected, it may be returned or destroyed according to the procedures of the destination country.

    If the return incurs costs for Grungemama, we may order its destruction without any possibility of a refund of the order.

  • Billing basis : Unless otherwise stated, payment is processed in euros . Any conversion, bank charges or exchange fees are the responsibility of the Buyer.

5. Payment

The order is binding and requires payment . Payment is due in full, via the methods offered on the Site:

  • Bank cards (Visa, Mastercard, Maestro) via Payplug (secure platform)

  • Apple Pay (depending on device and browser compatibility).

Providing card details authorizes the debiting of the total amount. In case of authorization refusal, non-payment, or any other anomaly, the Seller may suspend or cancel the order.

6. Availability, preparation and shipping

  • Preparation : within 2 to 5 working days (excluding announced closure periods and force majeure), from the order confirmation email.
  • Shipping & tracking : a notification email is sent upon shipment, with a tracking link if applicable.

7. Delivery

Delivery corresponds to the transfer of physical possession or control of the Product to the Buyer. It takes place at the address indicated when the order was placed, after confirmation of payment.

  • Estimated delivery times in France : delivery within a few working days after dispatch; maximum delivery time 15 days from the date of order registration.
  • International : delivery time varies depending on the country and the carrier; customs formalities and delays may extend it.
  • Incorrect address : packages returned due to incorrect/incomplete address may be reshipped at the Buyer's expense .

Delay : If the maximum deadline is not met, the Buyer may formally demand that the Seller perform within a reasonable additional period; failing that, the Buyer may cancel the sale and obtain a refund within 14 days.

8. Acceptance and reservations

  • If the package is damaged (open, torn, wet…), check the condition of the Products and, if necessary, refuse the package , noting specific reservations on the delivery slip.
  • Confirm the reservations to the carrier by registered mail within 2 working days and send a copy to the Seller.

9. Delivery errors and non-conformities

Any claim (product error, missing product, non-conformity) must be submitted on the day of delivery or at the latest on the next working day :

Any product to be exchanged or refunded must be returned complete, unworn, and in its original packaging , using the shipping method provided by the Seller, to: 14 bis avenue Hermès, 31240 L'Union, France . Return shipping costs are the responsibility of the customer.

10. Right of withdrawal & returns

Legal deadline : For distance orders within the EU, the Buyer has a period of 14 days from receipt to exercise their right of withdrawal without giving any reason.

Grungemama Policy : We accept returns within 15 days of delivery, for refunds of unused, unworn items with original tags and intact packaging, or for exchanges subject to availability.

Return shipping costs are the responsibility of the Buyer. The Seller may refuse a return that is late or not in its original condition.

11. Legal Guarantees

The Products are covered by legal guarantees : conformity (Art. L.217-4 et seq. of the French Consumer Code) and hidden defects (Art. 1641 et seq. of the French Civil Code). The Buyer may take action under these guarantees in accordance with the conditions provided by law.

12. Risk Transfer

The risk of loss and damage passes to the Buyer upon delivery . The Products travel at the Seller's risk until that point.

13. Combating fraud

The Seller reserves the right to block or cancel any order in the event of non-payment , inconsistent address or suspicion of fraud , after informing the Buyer.

14. Intellectual Property

All content on this Site (photos, visuals, texts, logos, designs) is protected. Any unauthorized reproduction or use is prohibited.

15. Force majeure

Events that are irresistible and unforeseeable (e.g., natural disasters, strikes, transportation disruptions, network outages) preventing the performance of obligations are considered force majeure. Obligations are suspended for the duration of the event; after three months, either party may terminate the agreement.

16. Personal Data

16.1. Purposes

The data is used for order management, delivery, customer service, fraud prevention and, with your consent, marketing.

16.2. Security and confidentiality

The Seller implements organizational, technical, software, and physical measures to protect data. However, since the Internet is not a completely secure environment, absolute security of transmissions cannot be guaranteed.

16.3. Your rights

In accordance with applicable regulations, you have the right to access, rectify, object to, erase, limit and transfer your data by contacting: contact@grungemama.com .

16.4. Evolution

This clause may be modified; the new version will be published on the Site and notified by email at least 15 days before it takes effect. If you disagree, you may delete your account.

After a prior written complaint to Grungemama's customer service, if no agreement is reached, the customer can refer the matter to the mediator free of charge within one year of her initial request.

18. Applicable law and competent courts

These terms and conditions are governed by French law . In the absence of an amicable agreement, any dispute will be brought before the competent French courts, without prejudice to mandatory consumer protection provisions.

19. Vouchers and credit notes

19.1. Gift voucher

  • A voucher cannot be exchanged for money , nor can it be divided into smaller amounts to give change.
  • Any order paid in whole or in part with a voucher will be credited, in case of return, exclusively in the form of a voucher , valid for 1 year , usable on the Site or in physical stores .

19.2. To have

  • The Buyer can opt for a credit note rather than a refund/exchange; the credit note is valid for 1 year on the Site and in physical stores .

20. Creating and Using the Customer Account

Creating a customer account on our store is required to place an order.

The customer account can be created by filling out the standard form or by using the quick login option via third-party services (such as Google or Facebook).

20.1. Connection via Third-Party Services

By choosing to connect via a third-party service (Google, Facebook, etc.), you agree that we may use the basic information (name and email address) provided by that service solely for the purpose of creating and managing your account on our store.

Using the third-party service connection implies acceptance of these General Terms and Conditions of Sale (GTC) and our Privacy Policy, which governs the use and protection of data transmitted by the third-party service.
